TEXT SMS POLICY

Text marketing: By signing up via text message, you agree to receive recurring automated promotional and personalized marketing text messages at the cell phone number used when signing up. You may opt out at any time. Message frequency varies. Message and data rates may apply. By opting into or participating in the mobile messaging program (the “Program”), you accept and agree to these terms and conditions and privacy policy (the “Agreement”) including, without limitation, your agreement to resolve any disputes with us through binding, individual only arbitration.

User opt in: The Program allows Users to receive SMS messages by affirmatively opting into the Program, such as through online or application-based enrollment forms or via verbal consent. Regardless of the opt-in method you utilized to join the Program, you agree that this Agreement applies to your participation in the Program. By participating in the Program, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to imply that any or all of our mobile messages are sent using an autodialer.

User opt out: If you do not wish to continue participating in the Program or no longer agree to this Agreement, you agree to reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any mobile message from us in order to opt out of the Program. You may also choose to fill out the online form at the bottom of this page to opt out of the Program. You may receive an additional mobile message confirming your decision to opt out of the Program. You understand and agree that the foregoing options are the only reasonable methods of opting out. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting an employee to remove you from our list, is not a reasonable means of opting out.

Duty to notify and indemnify: If at any time you intend to stop using the mobile telephone number that has been used to subscribe to the Program, including canceling your service plans or selling/transferring the phone number to another party, you agree that you will complete the User Opt Out process set forth above prior to ending your use of the mobile telephone number. You understand and agree that your agreement to do so is a material part of these terms and conditions. You further agree that, if you discontinue the use of your mobile telephone number without notifying us of a change, you agree that you will be responsible for all costs (including attorneys’ fees) and liabilities incurred by Us, or any party that assists in the delivery of the mobile messages, as a result of claims brought by individuals(s) who are later assigned that mobile telephone number. This duty and agreement shall survive any cancellation or termination of your agreement to participate in any of our Programs.

Cost and frequency: Message and data rates may apply. The Program involves recurring mobile messages, and additional mobile messages may be sent periodically based on your interaction with Us.

Support instructions: For support regarding the Program, text “HELP” to the number you received messages from.

Disclaimer of Warranty: The Program is offered on an “as-is” basis and may not be available in all areas at all times, and may not continue to work in the event of product, software, coverage or other changes made by your wireless carrier. We will not be liable for any delays or failures in the receipt of any mobile messages connected with this Program. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of Our control. ERC BUILDER LLC is not liable for delayed or undelivered mobile messages.

Participant requirements: You must have a wireless device of your own, capable of two-way messaging, by using a participating wireless carrier, and be a wireless service subscriber with text messaging service. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions.

Miscellaneous: You warrant and represent to Us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in this Agreement or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect and right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of this Agreement is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect and enforceable. Any new features, changes, updates or improvements of the Program shall be subject to this Agreement unless explicitly stated otherwise in writing. We reserve the right to change this agreement from time to time. By continuing to participate in the Program after any such changes, you accept this Agreement, as modified.

PRIVACY POLICY

Card Claim Secure strives to be transparent with all clients. This document outlines the legal collection, use, distribution, storage, and maintenance of the data and information, both personal and non-personal, collected during any business interaction, whether through phone, email, website form, personal interaction, meeting, etc. Please read through each section of this document, and contact us with any related questions or concerns.

Legal Agreement. Please read this Privacy Policy (“Privacy Policy”) carefully. Your registration at and use of CardClaimSecure.com (“Website”) for services and information (the “Services”) offered by Card Claim Secure, or any of its subsidiaries including without limitation, Card Claim Secure, Card Claim Secure any of its (“Subsidiaries”), on the Website, and your acceptance of the Website Terms and Conditions (“Agreement”), create a binding, legal agreement between Card Claim Secure and you (“you” or “your”). This Privacy Policy is a material component of the Agreement and governs Card Claim Secure’s collection, use and/or sharing of any information you provide to Card Claim Secure in or about your use of the Website and/or the Services. This Privacy Policy further governs Card Claim Secure’s collection, use and/or sharing of information you provide Card Claim Secure in creating an account on the Website, which may include, without limitation, information such as your name, e-mail address, physical address, phone number, cell phone number (“Personal Information”), credit or debit card information (“Credit Card Information”), social security number, business financial information of any kind or nature, description of business plan or opportunity of any kind or nature, and any other personally identifying information related to you and/or your business. (“Sensitive Information”). Any terms and conditions not expressly set forth in this Privacy Policy are governed by the Agreement. If you choose to accept this Privacy Policy, as incorporated within the Agreement, you must do so as written, without modification. If you do not accept this Privacy Policy you will not be allowed to receive the Services. By using the Website, you openly and affirmatively acknowledge and agree you have read and you accept this Privacy Policy.

Information Collected by Card Claim Secure. Card Claim Secure, from time to time, may engage trusted, industry-standard third party providers to provide financial account aggregation services. Your Personal Information may be transmitted to such third party providers and securely stored on their servers, including without limitation any of the Subsidiaries. Card Claim Secure is not responsible for any of any third party provider’s actions or inactions. You authorize Card Claim Secure to provide such third party providers with your Personal Information. Any Non-Personal Information used in a combined format with Personal Information will be treated as personal information.

You may use the Website without creating an account. Even without an account, Card Claim Secure may collect Personal Information about your use of the Website. This may include information about any Internet protocol address you use to access the Website and/or your activity or patterns of activity using the Website. You authorize Card Claim Secure to use cookies, or other small text files stored on your computer, server log files, environmental variables (such as computer type), pixel tags, and other non-personal information you voluntarily provide (such as geographic location) to store data about your visits and you authorize Card Claim Secure to access such data.

We collect personal information and non-personal information through the Site. Personal information is information that identifies you as an individual. Non-personal information is aggregated information, demographic information, IP addresses and any other information that does not reveal your specific identity.

Personal information. We may collect the following types of personal information:

Information provided by you when ordering credit-related products through the Site. For example, you will be required to submit personal information such as your name, address, social security number, date of birth, telephone number and e-mail address
Information provided about your children when enrolling your children in child identity monitoring products. For example, as a legal guardian, you will be required to submit the child’s first and last name, Social Security number, and date of birth in order to register that child in identity monitoring with the credit bureau.
Credit and debit card account information collected from you or your credit reports when enrolling in our card registry product. For example, we will collect credit and debit card account information from you on our sites, over the phone, and from your credit reports from the three national credit reporting companies in order to cancel the cards per your request in the event that they are lost or stolen.
When you make a purchase through the Site, we may collect your credit card number or other payment account number, billing address and other information related to such purchase (collectively, “Payment Information”) from you.
Other information we collect, such as city of birth and mother’s maiden name, is used to verify your identity in the event you forget your login information required for our online products.
Information you provide us through customer service correspondence and general feedback.
Video content you choose to submit to us, such as commentary about our products and services, testimonials, or other similar content you share through video.

Non-Personal information. When you visit the Site, we may collect non-personal information, such as a catalog of the Site pages you visit. Non-personal information is generally collected through the Site from the following sources: server log files, environmental variables, cookies, pixel tags and other similar technologies and information that you voluntarily provide.

Server Log Files. Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We use your IP address, and the IP addresses of all users, for purposes such as calculating Site usage levels, helping diagnose problems with the Site’s servers, and administering the Site. Pixel Tags. We, our service providers, and/or non-affiliated Third-parties, may also use so-called “pixel tags,” “web beacons,” “clear GIFs” or similar means (collectively, “Pixel Tags”) in connection with some Site pages and HTML-formatted e-mail messages to, among other things, compile aggregate statistics about Site usage and response rates. A Pixel Tag is an electronic image, often a single pixel (1×1), that is ordinarily not visible to Site visitors and may be associated with Cookies on the visitors’ hard drives. You understand that any such removal is only intended to result in the removal of your Personal Information from Card Claim Secure, LLC’s own records, but will not result in, nor will your request create an expectation of, any removal of any information about you from the Available Information.
Other Information. Card Claim Secure may store, and you authorize Card Claim Secure to store, your Credit Card and/or Sensitive Information solely for its purposes. Card Claim Secure will not share your Credit Card and/or Sensitive Information for any purposes, unless Card Claim Secure first obtains your prior written consent to do so.
Aggregate Information.Notwithstanding anything in this Privacy Policy to the contrary, Card Claim Secure may use any information you provide, when aggregated with others’ information, to provide trend analysis of market segments, business growth patterns, or any other trending information. In such event, Card Claim Secure will not use any personally-identifying information you have provided in any manner which will divulge you or your business in such trending analysis. Further, Card Claim Secure may use your information to provide case studies, provided you cannot and will not be able to be identified in such event.
Use and Sharing of Your Personal Information.
a) Card Claim Secure may use your Personal and Non-Personal Information to create and maintain your account, to personalize your experience, to complete administrative and internal communications, to fulfill purchases of our products and services, to transfer in the event of a merger or similar event (in which transferring information would enable a smooth transition to continue fulfillment of requested products and services), and to send periodic e-mail communications relating to the Service, such as purchase receipts, account confirmations, and customer service correspondence.
b) You understand and agree Card Claim Secure may monitor usage on the Website and the Services and may share your use of the Website and Services with law enforcement agencies and officials in response to inquiries or if Card Claim Secure has reason to believe your use of the Website and Services is for an unlawful purpose. Card Claim Secure may share your use of the Website and/or Services as required by law, a court order, a subpoena or other court proceedings, or as Card Claim Secure determines is necessary or advisable to protect its interests.
c) Card Claim Secure may use your Personal Information to improve the Website and the Services. Card Claim Secure may share Internet protocol addresses used to access the Website with designated third parties to prevent and detect fraud. Card Claim Secure may use services and technologies provided by other companies to assist Card Claim Secure in understanding your use of the Website. TEXT AGREEMENT

Claim Card Secure is committed to upholding the highest standards of privacy for all personal information collected through our text messaging services. We do not sell, rent, distribute, or trade your personal data to third parties without your explicit consent unless legally required to do so. Any information shared with third parties is exclusively for the purpose of delivering our services to you. We assure you that your data will never be shared with third parties for marketing purposes.

By subscribing to Claim Card Secure’s text messaging service, you agree to receive [specify the type, e.g., promotional, transactional, or informational] messages related to [describe the content, e.g., products, services, updates, special offers]. You can expect to receive [specify frequency, e.g., up to 5 messages per week]. Message and data rates may apply. You can opt out of receiving these messages at any time by following the instructions provided in each message.

If you no longer wish to receive text messages from us, you can opt out at any time by replying with the word ‘STOP’ or ‘UNSUBSCRIBE’ to the number from which you received the message. Upon receiving your request, we will promptly remove you from our messaging list, and you will no longer receive further text communications from us.

SECURITY MEASURES

We have security measures and tools, such as firewalls, in place to help protect against the loss, misuse and alteration of the information under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you might have with us has been compromised), please notify us of the problem as soon as possible.

Changing information.
